These Terms of Service ("Terms") govern your access to and use of the hosting and related services ("Services") provided by Orietech, trading name of AI-ENGAGE LTD, registered in England and Wales. Registered office: 71-75, Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ. ("Orietech", "we", "us"). By creating an account or using the Services you agree to these Terms.
You must provide accurate registration details and keep your login credentials secure. You are responsible for all activity under your account. Notify us promptly at support@orietech.co.uk if you believe your account has been accessed without authorisation.
We provide shared hosting and virtual private server hosting on the plans described on our pricing pages. Resource limits, included features and any fair-use thresholds applicable to your plan form part of these Terms.
We target the uptime figure stated for your plan, measured monthly excluding scheduled maintenance announced in advance and events outside our reasonable control. Where a measured monthly availability falls below the committed figure, you may request the service credit described in your plan documentation.
We may carry out maintenance that briefly interrupts the Services. Where maintenance is likely to be disruptive we will give reasonable notice through the client area or by email.
Your use of the Services is subject to our Acceptable Use Policy, which is incorporated into these Terms. Material breach of that policy may result in suspension or termination.
You may cancel and request a full refund within 30 days of first signing up. After that period, annual plans are refundable on a pro-rata basis for complete unused months. Cancellations take effect at the end of the current billing term unless a refund is requested under this clause.
You retain ownership of the data and content you host with us. We take routine backups as described for your plan, but you remain responsible for keeping your own independent copies of anything important. We are not liable for loss of data that could have been avoided by your own backups.
We may suspend or terminate the Services where there is a material breach of these Terms or the Acceptable Use Policy, non-payment, or a credible risk to the security or stability of our infrastructure or other customers. Where practical and lawful we will give notice and an opportunity to remedy.
Nothing in these Terms excludes liability that cannot lawfully be excluded. Subject to that, our total liability arising out of or in connection with the Services is limited to the fees paid by you for the Services in the twelve months preceding the event giving rise to the claim. We are not liable for indirect or consequential loss, or loss of profit, revenue or data.
We may update these Terms from time to time. Material changes will be notified through the client area or by email. Continued use of the Services after a change takes effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
